It is time for Jon Kyl to apologize to the Supreme Court, the citizens of Arizona, and his colleagues for misleading them.

Jon Kyl and Lindsey Graham of South Carolina got together to write a fictional debate, including banter and interruptions from other Senators, and quietly slipped it into the Congressional Record after a debate on the treatment of Guantanamo Bay detainees. Then Kyl implied that the “debate” was live in a legal brief he filed with the Court, and the Bush administration, to prove its case, referenced the Kyl-Graham “debate” in its court filings.

Congressman and Senators often insert items into the Congressional record after debates, but what was unusual and dishonest in Kyl’s move was the lengths he went to make the debate seem like it actually happened on the floor. The reason for this is clear, he intended to mislead the Supreme Court about the intention of the law being debated.

Two weeks ago Kyl was outed by the Supreme Court for trying to mislead them.

When asked about his deception he refused to comment. But after the pressure from the media became too much, he put forward his new excuse: “Everyone does it.”

Supreme Court justices typically read the record to figure out the lawmakers’ legislative intent. So Kyl was trying to trick the justices into believing the lawmakers meant something they didn’t.

Republicans, legal scholars, and even a US Senate historian criticized Kyl for his dishonesty.

But, Kyl still refuses to admit he was wrong and won’t apologize to the Supreme Court, the people of Arizona, or his fellow Senators.

With the U.S. Senate coming back in session this week, this is a good opportunity for Jon Kyl to take to the floor and apologize for his deception. Or maybe if he doesn’t want to do it live, he could do what “everyone does” and insert his apology into the Congressional Record.
