The man FOX news nicknamed America's toughest sheriff a few years ago has been called to task by the courts and it may cost Maricopa county tax payers more cash.
The Arizona Court of Appeals ruled the Sheriff's failed to comply with state law and provide public documents in a timely manner to a Phoenix-based weekly newspaper.
A panel of three appellate judges ordered the case be remanded to county Superior Court to determine whether the Phoenix New Times is entitled to tens of thousands of dollars in attorneys fees if the sheriff's office acted arbitrarily, capriciously and in bad faith.
The case dates to spring of 2004 when a New Times reporter began a series of investigative articles about Sheriff Joe Arpaio. Those stories included one that led to charges against the newspaper for publishing Arpaio's address online and the October 2007 arrests of two New Times executives when they published the contents of a grand jury subpoena.
In September 2004, New Times filed a petition for special action in Superior Court to compel the sheriff's office to honor nine separate public-records requests and also asked to be reimbursed for attorneys fees.
Superior Court Judge Michael Jones granted the motion but refused to award the attorneys fees, which New Times attorney Steven Suskin would only say totaled tens of thousands of dollars. The new times appealed, resulting in yesterday's ruling in Phoenix New Times v. Arpaio.
Although Arizona public-records laws do not set a specific number of workdays in which to provide public documents, several of the New Times' requests took more than three months to fill, according to the newspaper.
One can only hope Chief Saban will be able to prevail in the election and restore some law and order to an office where the fellow now in charge seems bent on ignoring it at a cost of millions to the tax payers who have been beguiled for years by political spin
it's those delightful shades he tints rhetorical semantics with in response to direct questions about solving the complex problems facing the next President.
Make no mistake He is capable and more than qualified to be the President. And if during the waning days of August we become unabashedly jubilant when we hear those solemn words" fellow democrats I accept your nomination". I have no doubt the big mo will become a tidal that uplifts him and all the people toward a November crest.
I speculate after the margin in South Carolina. He too must wake each morning with new-found clarity discerned in the wake of so decisive a route .
I imagine even amongst republicans not swilling too deeply from the chalice of sweet ideological elixir. Offered by the evangelical neoconservative right. The hope at best is to stem as many losses in the congress and State houses as possible .
But still I ask is the senator who seems possessive of the charm of a Kennedy and the Character of another President from Illinois, really more qualified than Hillary Clinton. Not by half and then some at least in my opinion.
I like Barack, the sincerity is not I suspect practiced, the charisma and charm is warm and inviting. He would make a dam fine President, perhaps a great one.
But Hillary is prepared to tackle the task ahead with the focus of a skilled battle surgeon cutting out a mushroom round from the body of one of our sons or daughters felled in Baghdad. Her steady hands unruffled by the unsettling thuds and booms of incoming motors as the Red state forces pepper the trenches with every nasty lie, innuendo and vulgarity they can muster.
Even now in the distance, I hear the faint murmurs of those who were able to beguile the people. To rally and join in a grand illusion of establishing "Jeffersonian Democracy in the middle east".
A quagmire it turns out, planned with all the foresight and gullibility of the eleventh century tragedy know as the children's crusade. While it's true that brilliant military tactician Donald Rumsfeld has gone off to reminisce with the aged Robert McNamara.
Who by the way was an original member of the Kennedy administration, Perhaps a topic Ted would rather not go into when you ask him. What exactly he wants for today's endorsement of Senator Obama. Just good government to be sure its not like Ted is the definition of status quo in foggy bottom.
I am sure a general or two can still be found willing to stand front and center on the stump. Declare with the same steely eyed unequivocal faith of a general Sanchez, that Victory is at hand if we but support the troops by continuing the surge and electing to the Presidency the honorable gentleman to his right.
True she lacks her husband's charisma and her opponents mystique. But Hillary is the better politician and leader then the both of them. I suspect in private the future first gentleman, would concede but for her he would have never made it past the Governor's Mansion. Much is made of senator Clintons attempt to reform health care during her husband's administration.
I say to reform anything requires it exists to begin with. I wonder how many Americans consider the Republican definition of what passes for health care in America as actual health care.
The kind they can afford and truly covers what they need. Without having to first choose between their children's college fund or their well being as they pay the monthly bills.
The American people are becoming all too aware in bits and jolts. The current administration has spent eight years doing little more than spending and borrowing, Borrowing and spending. To float the economy and finance every ill conceived and reckless adventure that might further a malicious ideology or benefit a "contributor" in the private sector.
The one thing all republican candidates do agree on is the need to further fuel the wild fire of the immigration debate. One created by those who wrap their racism in a Flag. A flag more often than not made in a sweat shop.
A patriotic banner waved to visually cue the media and enlighten the uniformed of a silent invasion. More vague alarms of urgent need to expel the undocumented who sneak into the Republic.
Protect our boarders less the "proof" come in the form of a suite case nuke. Perhaps smuggled in on the back of a child crossing the border. Unaware of the consequences even a small vile of bio chemical apocalypse will effect on those who failed to heed the call. To stock up on duck tape and plastic issued in directive seven by the ministry of homeland security
Yes my friends they do Sneak in. But only for the opportunity to toil dawn till dusk for those who oddly seem to vote republican. And have little moral conflict in exploiting women and children, desperate even for a chance to labor at jobs none of us would do for a hundred times the amount.
A Clinton or Obama administration will indeed need to spend long hours defining the real problems raised by too many future Americans having to sneak in. They do to in order to begin writing their own American success story. But it must be a solution which includes input from responsible leaders on both sides of the debate and political spectrum.
The Elmer Fudd brigades of weekend patriots who gather on street corners in places like Phoenix and scream at the top of their lungs how the wetbacks are destroying the economy need to be disbanded.
If it's a want to engage in some corporal expression of evangelical patriotic zeal that motivates them. I hear the state department is at present in search of loyal patriots to fill posts in the non civil war zone. Perhaps they could catch a ride with the non mercenaries employed by black water. Making ten times the amount our own soldiers are paid, which is only fair since they need to pay for their own body armor. Lord knows we didn't have enough for our own troops so there couldn't have been much to spare for the private sector
But the campaign debate has begun to focus on the sinking economy and the republicans in charge of your local predatory lending institution and those corporate CEO's the ones who shipped all your jobs overseas to take advantage of the cheap labor. They are the responsible parties you need to speak with on the topic of economic down turn.
The recession that is about to happen is in great part due to the Red Menace that brother John Birch spoke of. Yes the Chinese are to blame my friends.
But it's not the evil influence of Marxism that will consequence your lay off brother patriot. It's all that debt Brother Bush and Cheney ran up these last eight years while the Rubber stamp GOP congress gave lots of sweet heart deals to Halliburton.
The major reason your money will be worth less and your children may die in Iraq, at least according to the leading republican candidates. Why it was all Donald Rumsfeld's fault for sending our forces into battle without basic supplies and the most important thing you need when you set out to make war an actual plan for after you win.
But then considering those not killed in the non-civil war looked forward to R&R with the rats at Walter Reed or being told their brain injury was not combat related. It's difficult to lay all the Blame at brother Rumsfeld's door.
If you think about it from a republican perspective, I mean the kind that resulted in denial of disability claims for injuries suffered from the roadside bombs. the ones that took out the Hummers that did not have the appropriate armor.
That land mind that left your son or daughter disabled for life. May technically speaking not have been enemy ordinance. It could have come from the vast stock piles we sold Saddam was he was our friend.
Perhaps if you were to tell the non-doctor appointee the shrapnel in your kids head is in fact from the military stock piles Oliver North sold to Iran twenty years ago. For the money republicans needed to buy drugs to help fund the freedom fighters in Nicaragua. It could become the smoking gun our President so desperately seeks to prove the Iranians are secretly behind alkida after all.
And while Lou Dobbs is right about the decline of the American middle class. He's only right by half. Brother Lou is preaching to the Choir on the need to excise the malignant cancer eating away at the body politic. I Brother Burton can report to one and all the middle class is way past decline. It's on deaths door and the Doctors in charge must have attended the Jack Kevorkian school of economics.
We have a fed so incompetent when a rogue trader in France gets nabbed and the markets shift. Those boys at the fed raise the interest rate. which could ignite inflation with the carelessness of a rich fellow parking his new SUV on the front lawn to show off .
Unaware a catalytic converter can spark a grass fire and burn the entire block leaving him only the charred ruin of a house he paid too much for. With borrowed money that was under-insured. Because he lacked the cash flow to cover his risk.
The problems the Republic faces are not beyond Senator Clinton or Obama's ability to tackle.
But the republicans will stop at nothing to convince the people to fear an enemy that is militarily insignificant, stroke just enough edge of uncomfortableness at the prospect of a Black man being President and attempt to cultivate so negative an image of the woman who should be our choice. It might fool the people into giving serious thought to electing someone who thinks "scriptural" economics will solve the short fall. That creation science is actually science. And torture is not really so bad provided the victim does not actually die during the interrogation.
At least that my view yours may be different.
Most decent members of valley law enforcement make jokes about the the man Fox calls Americas toughest Sheriff. and considering what became of anti-semitic J.D.Hayworth in the 06 midterms.
Chief Saban stands a chance of taking boss Arpaio's political machine down in the voting booth. I for one will offer my financial and blog support to the Saban campaign.
We are but ten short months away from restoring the rule of law to the republic in the Presidential election.
How sweet that morning after would be if we wake and discover that like the fabled Kansas city boss Tom Pendergast.
Sheriff Joe Arpaio's bed of abuse, corruption and greed has been made and he must retire to it and away from public life.
Of course hoping that Maricopa county attorney Andrew Thomas would likewise be out of work is perhaps a bit to much a burden to place on the good lords shoulders as we pray for a complete route of neoconservatives.
P.S Burton For Blogger Nations
The former Michigan congressman, Stands accused of money laundering, conspiracy and obstructing justice for lying to senators about an Islamic charity that authorities claim was in fact secretly funding terrorists.
The entire 42-count indictment, was unsealed in U.S. District Court in Kansas City, Mo., And accuses the Islamic American Relief Agency of paying Siljander $50,000 for his lobbying efforts. Money that it turns out, was stolen from the Agency for International Development.
Siljander served two terms in the House and was later appointed by then President Reagan to serve as a delegate to the United Nations in 1987. Mr. Siljander could not reached for comment and his attorney in Kansas City, JR Hobbs, had no immediate comment for the media.
The charges reflect a long-running investigation into the charity's activities, originally based in Columbia, Mo., It was designated by the Treasury Department as a fundraising shill for terrorists in 2004. The government claims I.A.R.A employed a man who served as a fundraising aide to no less then Osama bin Laden.
The formal charges allege the I.A.R.A sent approximately $130,000 to Gulbuddin Hekmaytar, a man designated as a global terrorist. Records show cash was deposited to bank accounts in Peshawar, Pakistan between 2003 and 2004, and listed as funds for an orphanage located in buildings that turned out to be owned by Hekmaytar.
Hekmaytar is an Afghan mujahedeen leader who engaged in terrorist attacks for al-Qaida and the Taliban publicly vowing to wage a holy war against the United States and international peace keeping forces.
The charges "paint a troubling picture of an American charity organization" that "engaged in transactions for the benefit of terrorists" and "conspired with a former United States congressman" to "convert stolen federal funds into payments for his advocacy," Assistant Attorney General Kenneth Wainstein remarked in public comments on the indictments.
Even more disturbing are the public records that indicate it was Siljander who established the Washington D.C consulting agency "Global Strategies" which employed several former republican House and Senate members, who left or were voted out of office. Former house and senate members retain special privileges of accessing current elected officials and areas of the capitol off limits to the general public and media.

Problem is I am a state employee; I am prohibited from using any of my work day time to express a political opinion about anything with a co-worker or to hang up or display any item that would be seen as sending a political message. Yes I can receive a phone call from Sen. McCain (recorded of course) to disrupt work time; time tax payers are paying for.
I called the Arizona Republican Party and asked how my phone number got on this list of calls, since they were paying for the call according to the message. I was passed around on the phone till one lady told me she would take my number off the list. I asked how it got there in the first place. She told me that the number came from the Board of Elections of the county.
I called the board of elections office in Phoenix, they were unsure, but promised to follow up and they did. I received a return call and was assured that there was no phone number in my records at the board to pass on to any political party or candidate organization.
So the office of the Arizona Republican Party lied. I am shocked and amazed that this could happen, a lie from the party of family values.
I would like to say that I have received no calls from any democrat candidate ever at my work number, but have received calls for the last several election cycles from lots of republican candidates and those that would speak for them.
It only reminds this old yellow dawg democrat that if you can hear a republican speak or see their lips moving you know they are telling yet another lie.
